 Dear client,
Through our on-line reservation service, you are contracting a tourist accommodation service, a service which is subject to the following conditions:
• As a general guideline, the reservation price exclusively includes: accommodation, accommodation and half board, or bed and breakfast. The availability and prices of requests for special services such as: a crib, extra bed, etc. that we haven't been able to include in the calculation of the on-line reservation, will remain pending confirmation by the hotel, who will do this by calling the customer.
• This service is directed exclusively and only at people of legal age with the necessary legal capacity to contract the services offered on this Web page. Users state that they understand and expressly accept the present conditions.
• Client registration: Contracting services on this Web page requires completing the user registration. Users are responsible for the truth of the data entered in this registration process as clients, and the site is not responsible for any consequences that could arise as a result of entering false or incorrect data. Likewise, clients must keep and save their passwords with maximum diligence that allow them to access the Plaza Hotels service. Plaza Hotels will not be responsible for any damages arising as a consequence of the improper use of this information by third parties.
• As regards the personal information provided by clients, clients declare that they expressly accept that Plaza Hotel:
- Includes an automated file containing their personal data that turns out to be necessary to adequately render their services. - Communicates this data to third parties when it is necessary for the adequate provision of the services they are contracting. - Uses the data obtained to be able to undertake commercial and promotional activities directed at the client, with the goal of notifying them about possible offers and/or promotions, as well as communications.
It is herein put on record that the manager of the file is the commercial entity ..................., for the purposes of users exercising their right to access, rectify, challenge and cancel, for which they should address their comments to the address San Nicolás de Bari Oeste (O), 502 La Rioja, Argentina.
• When arriving at the hotel, clients must deliver at reception the voucher corresponding to their on-line reservation.
• When making on-line reservations, and in order to obtain confirmation, credit card data must be entered where we will proceed to charging 10 % of the total reservation amount. The remaining 90 % must be paid when checking into the hotel.
• The total and final calculation of the reservation price includes VAT, except when this is expressly not included. Any other rate or tax affecting the final price will additionally be paid to the hotel establishment.
• As a general rule and except when another thing is expressly agreed, rooms may be used starting at 12:00 noon on the day of arrival and must be vacated by 12:00 noon on the day of your departure. The reservation is guaranteed until 6:00 pm on the day of arrival, due to which, if the user plans to arrive at the hotel at a different time than the aforementioned schedule, it is advisable to notify the hotel of these circumstances as much in advance as possible.
• Cancelling the reservation. For the 15 days following the date when the reservation was made, it can be cancelled without cost by sending an e-mail to reservas@plazahotel-larioja.com , or via telephone by calling +54 (03822) 425 215 or via fax be faxing l +54 (03822) 422 127 always stating the reservation number on your communication.
• After this 15 day period described above has gone by, the cancellation will involve the loss of 10% of the pre-payment. Furthermore, if the cancellation is made with under 15 days of advance notice from the planned arrival date, or not cancelled at all, the user will be charged 20% of the total amount (10% in addition to the pre-payment) on their credit card before proceeding to the cancellation of the reservation.
• Bank expenses incurred through the cancellation of reservations will be charged to clients. In all cases, the corresponding invoice will be sent to the address entered by the client when registering as a user.
• Modifying the reservation. Reservations made can be subsequently modified via e-mail to reservas@plazahotel-larioja.com, or via telephone by calling +54 (03822) 425 215 or via fax be faxing +54 (03822) 422 127 always stating the reservation number on your communication. The success of this modification will depend on the availability of the Plaza Hotel at the time of the request.
• Offers will only be valid during the period stated by the Plaza Hotel on the advertisement, or in default of this, during the time these offers are accessible to clients for effective contracting.
• Customer rights:
- All information provided to the client will be binding to the provider under the terms established by consumer protection legislation.
- All users of tourist services have the right to the fact that the goods and services acquired are of the category and legal requirements contracted, or of a quality that maintains a direct proportion with the rating of the tourist establishment.
- All establishments have the obligation of making a complaint book available to customers so that they may leave record of their complaint. In order to make a complaint, request the corresponding sheets, fill in your personal data and clearly indicate the reason for the complaint.
• Client obligations: While enjoying the tourist services they have contracted, all users have the following obligations:
- To pay the price for the contracted services, with the presentation of a complaint or claim not exonerating them from this obligation.
- To comply with the particular rules of the hotel establishment whose services they are enjoying.
- To observe rules for hygiene, politeness and good manners towards the rest of the users and personnel of the hotel establishment rendering their services.
- To respect the environment.
• If the Plaza Hotel notifies clients about the cancellation of the reservation due to reasons of force majeure, understood as those circumstances that are outside of anyone's control, being abnormal and unforeseeable, whose consequences could not have been avoided in spite of having acted with all due diligence, the reservation will be cancelled without the right to file a claim or receive compensation by the user or client. This condition will be communicated - if this is possible - by the means used for the confirmation of the reservation.
• The Plaza Hotel reserves the right to make any modifications to these conditions that they deem necessary.
• Clients accept that the legislation applicable for the operation of this service is Spanish legislation and will be subject to the courts and tribunes of the Balearic Islands for the resolution of any conflicts stemming from the interpretation and application of the present contract. |
